PREAMBLE
Whereas thousands of Kashmiri‑origin families migrated
from the territories of the former princely State of Jammu & Kashmir to
regions that later became Pakistan prior to the year 1947;
Whereas these families, despite their ancestral,
hereditary, cultural, and historical ties to Jammu & Kashmir, have remained
undocumented, unrecognized, and unrepresented for successive generations,
resulting in the erosion of their legal identity and exclusion from the
constitutional and civic framework of the State;
Whereas the absence of State Subject documentation has
deprived these families of their rightful identity, civic rights, and political
representation within the constitutional structure of Azad Jammu & Kashmir,
thereby creating a prolonged and unjust gap in their legal status;
And whereas principles of justice, dignity, equality, and
historical continuity demand the restoration of their rightful legal identity,
documentation, and representation as original citizens of Jammu & Kashmir;
Therefore, this Foundational Instrument hereby
establishes The Kashmiri‑Origin, Legal Identity, Documentation &
Representation Foundation (KLIRF), Pakistan) as a national institution
dedicated to the recognition, documentation, protection, and representation of
Kashmiri‑origin citizens residing across Pakistan.

SECTION I — NAME, STATUS &
MANDATE
Article 1 — Name
The organization shall be formally known as: The
Kashmiri‑Origin, Legal Identity, Documentation & Representation Foundation
(KLIRF), Pakistan.
Article 2 — Legal Status
KLIRF shall operate as a non‑profit, non‑political,
civil society institution under the laws of Pakistan. It shall remain
independent of political parties, sectarian affiliations, and governmental
influence, except where cooperation is required for lawful documentation and
representation.
Article 3 — Mandate
KLIRF is mandated to restore, document, and represent
Kashmiri‑origin citizens whose families migrated from Jammu & Kashmir
prior to 1947, and to ensure their rightful inclusion in the legal, civic, and
political identity of the Kashmiri people.
SECTION II — INTRODUCTION
KLIRF is established to address a historic and systemic
gap in identity and documentation affecting millions of Kashmiri‑origin
families living across Pakistan. For decades, these families have lived without
State Subject Certificate‑I (SSC‑I), without voter recognition, and without
representation in the AJK Legislative Assembly.

SECTION III — GENERAL OBJECTIVE
To secure legal recognition, hereditary documentation,
and political representation for all Kashmiri‑origin citizens residing in
Pakistan, ensuring their rightful inclusion in the civic, cultural, and
constitutional identity of Jammu & Kashmir.
SECTION IV — SPECIFIC OBJECTIVES
Article 4 — Identity Restoration
To establish hereditary lineage‑based recognition of
Kashmiri‑origin families and facilitate issuance of SSC‑I through verified
genealogical, historical, and documentary evidence.
Article 5 — Documentation & Archival Development
To create a national registry and digital archive of
Kashmiri‑origin families, preserving genealogical records, migration histories,
ancestral documentation, and oral histories.
Article 6 — Representation & Advocacy
To advocate for legislative recognition and allocation of
reserved seats in the AJK Legislative Assembly for approximately 8 million
undocumented Kashmiri‑origin citizens living across Pakistan.
Article 7 — Legal Support
To provide advisory assistance for documentation,
verification, and submission of SSC‑I applications, including guidance on
appeals and disputes.
Article 8 — Public Awareness & Education
To promote awareness of Kashmiri heritage, rights, and
identity through seminars, publications, community outreach, and cultural
preservation initiatives.
Article 9 — Institutional Collaboration
To coordinate with governmental, academic, archival, and
international bodies for recognition of Kashmiri‑origin citizens under relevant
laws, conventions, and administrative frameworks.
SECTION V — RIGHTS OF KASHMIRI‑ORIGIN
CITIZENS
Article 10 — Right to Identity
Every Kashmiri‑origin citizen has the right to be legally
recognized under hereditary lineage as an original citizen of Jammu &
Kashmir.
Article 11 — Right to Documentation
Every eligible individual has the right to obtain SSC‑I
through verified genealogical and historical evidence, supported by KLIRF’s
documentation process.
Article 12 — Right to Representation
Kashmiri‑origin citizens have the right to representation
in the AJK Legislative Assembly through reserved seats and inclusion in voter
rolls.
Article 13 — Right to Cultural Continuity
Citizens have the right to preserve, practice, and
transmit Kashmiri cultural, historical, and linguistic identity.
Article 14 — Right to Equal Access
Citizens have the right to equal access to
administrative, legal, and governmental processes concerning Kashmiri identity
and representation.
SECTION VI — RESPONSIBILITIES OF
KLIRF
Article 15 — Integrity & Transparency
KLIRF shall maintain accuracy, transparency, and ethical
standards in all documentation, verification, and archival processes.
Article 16 — Non‑Political Character
KLIRF shall remain strictly non‑political, non‑sectarian,
and inclusive, ensuring neutrality in all operations.
Article 17 — Data Protection
KLIRF shall safeguard the privacy, dignity, and
confidentiality of all registered individuals and families through secure data
management systems.
Article 18 — Compliance
KLIRF shall comply with national laws, AJK regulations,
and international norms relating to identity, documentation, and human rights.
Article 19 — Community Service
KLIRF shall serve as a bridge between undocumented
Kashmiri‑origin citizens and relevant state institutions, facilitating access
to documentation and representation.
SECTION VII — FUNCTIONS OF KLIRF
Article 20 — Verification & Certification
Conduct genealogical, historical, and documentary
verification for SSC‑I recommendations, including oral history collection and
archival cross‑checking.
Article 21 — Registry & Archival Development
Maintain a comprehensive database of Kashmiri‑origin
families, including migration records, genealogical trees, ancestral
documentation, and digital archives.
Article 22 — Legislative Advocacy
Engage with AJK and Pakistan authorities to secure
representation, recognition rights, and legislative reforms.
Article 23 — Community Mobilization
Organize awareness campaigns, workshops, cultural
programs, and outreach initiatives to strengthen Kashmiri identity and
community cohesion.
Article 24 — Legal Advisory
Provide guidance for documentation, citizenship claims,
SSC‑I applications, appeals, and representation petitions.
Article 25 — International Liaison
Represent undocumented Kashmiri diaspora in global forums
concerning identity, human rights, and heritage preservation.
SECTION VIII — REQUEST TO THE AJK
LEGISLATIVE ASSEMBLY
KLIRF formally requests the AJK Legislative Assembly to:
